We would like to emphasize that this measure, in addition to being contemplated within our establishment's internal policy, is also protected by current Spanish regulations. In fact, the following applies: Law 28/2005, of December 26, on health measures against smoking, establishes in its Article 7, section t) the prohibition of smoking in hotels, hostels, and similar establishments, except in rooms expressly designated for smoking in accordance with the law. Article 19 of the same law classifies smoking in prohibited areas as an infraction, and Article 20 establishes financial penalties ranging from 30 to 600 euros for these behaviors. Therefore, we understand that smoking in our hotel's rooms and common areas is not only a breach of contract, but also a legal violation under Spanish law. Consequently, we request that Booking.com consider smoking in unauthorized areas "compensable damage" within the platform, so that properties can pass on the costs arising from this breach to the responsible guest, as is the case with other material damages. We are convinced that this measure would not only protect the legitimate interests of accommodations but would also strengthen customer confidence, aligning with current legal and health regulations in Spain.
Please note that under Royal Decree 933/2021, effective February 1, 2025, hotels in Spain may request certain personal information at check-in, including but not limited to identification, address, email, and phone number for guests 14 and older, as well as proof of relationship with minors under 14.
